General terms of use
1. Purpose
EchoRun is a service that lets a runner share the route of a race so that their friends and family can leave voice messages on it, triggered by geolocation during the event. Using the service implies unreserved acceptance of these terms.
2. Access to the service
Creating a runner account is free and requires a valid email address. Leaving a voice message as a friend requires no account. The service is provided "as is", available 7 days a week subject to maintenance operations and the technical uncertainties inherent to the Internet.
3. Pricing and payment
The service is free for the runner. Each race comes with 15 free voice messages; beyond that, the runner can unlock the race to receive more, at the rate shown before payment, with no subscription or renewal. Payments are processed by Stripe. An invoice is available on request.
Right of withdrawal. As this is digital content supplied immediately, the buyer acknowledges, by confirming their purchase, that they waive their fourteen-day right of withdrawal as soon as the message is effectively recorded. A credit purchased and not used is refundable on simple request within fourteen days.
4. Content posted by users
Each person leaving a voice message remains solely responsible for its content. The following are strictly forbidden: insulting, defamatory, hateful, threatening or sexual remarks, incitement to violence or discrimination, as well as any content infringing the rights of third parties, notably the use of protected musical recordings.
The recipient runner can delete a received message at any time and report abusive content. We reserve the right to remove without notice any content reported as manifestly unlawful and to block access to the service concerned.
5. Safety during physical activity
Using the service during physical activity is the sole responsibility of the user. It is up to them to stay attentive to their surroundings, to comply with the rules of the event they take part in • some organizers prohibit wearing headphones • and with traffic laws. We recommend headphones that let outside sounds through.
6. Limitation of liability
The triggering of messages depends on GPS signal quality, on the user's hardware and operating system, and on compliance with the preparation instructions (prior download, app in the foreground, active screen). We do not guarantee that every message will play to the meter, nor that no message will be missed. We cannot be held liable for a non-trigger, poor sporting performance, battery drain, or indirect damage.
7. Intellectual property
The EchoRun brand, the domain name, the interface, the texts and the source code are the exclusive property of the publisher. Any unauthorized reproduction is forbidden. Users retain all rights to the voice messages they leave and grant the publisher only a technical license, strictly limited to hosting and delivering the message to the recipient runner.
The map backgrounds are provided by OpenStreetMap (ODbL license) and CARTO. Imported GPX routes remain the property of their authors or organizers.
8. Suspension and termination
The user can delete their account at any time from their dashboard or by simple request. We may suspend an account in the event of a serious breach of these terms, after informing the person concerned except in an emergency.
9. Personal data
Data processing is detailed in our privacy policy, which forms an integral part of these terms.
10. Governing law and disputes
These terms are governed by French law. In the event of a dispute, an amicable solution will be sought before any legal action. Consumers may use a consumer mediator free of charge. Failing agreement, the French courts have jurisdiction.
Accessibility
We aim for compliance with the RGAA (the French accessibility standard). If you run into a difficulty accessing a feature, report it to bonjour@echo-run.app: we handle these reports as a priority.
